Standalone ECU Tuning Disclaimer

At Motorsport Calibrations, your safety and the integrity of your vehicle are our top priorities. Remote tuning is a collaborative and complex process requiring preparation and understanding of potential risks. By using our remote standalone ECU tuning services, you acknowledge and agree to the following terms:


Customer Responsibility

  1. Pre-Testing Responsibility: Ensure that the vehicle’s oil and water levels are checked and maintained at the recommended levels before tuning begins. Failure to perform these checks may result in engine damage during tuning, for which Motorsport Calibrations assumes no liability.

  2. Mechanical Condition: Verify that your vehicle is mechanically sound. Any pre-existing issues, including leaks, worn components, or engine faults, must be resolved prior to tuning to prevent potential damage.

  3. Recommended Checklist:

    • Perform regular maintenance and ensure the vehicle is up-to-date.

    • Check for fluid leaks, inspect the cooling system, and test battery health.

    • Use high-quality fuel and scan for fault codes using an OBD-II scanner.

    • Inspect drive belts for signs of wear or damage.

    • Ensure tires are properly inflated and have sufficient tread.

    • Conduct a visual inspection of the engine bay for visible issues.


Equipment and Setup

  1. Hardware Requirements: Remote tuning requires appropriate hardware and software, such as a laptop, standalone ECU, and stable internet connection. Motorsport Calibrations is not responsible for delays caused by incompatible or malfunctioning equipment. Customers should ensure their equipment is compatible with the tuning process prior to the session.

  2. Setup Responsibility: Customers must ensure proper installation of all required equipment, including wideband sensors and logging tools. If assistance is needed, additional fees may apply.


Parts Liability

  1. Customer-Supplied Parts: Motorsport Calibrations does not assume liability for parts supplied by customers. For optimal results, we recommend parts be supplied and fitted by us. Using substandard or incompatible parts may affect tuning results and vehicle performance.

  2. Warranty on Fitted Parts: Parts supplied and installed by Motorsport Calibrations are covered by a 1-year manufacturer’s warranty, which is voided if altered or repaired outside our facility.

  3. Third-Party Performance Parts: If customers install performance parts from third parties unrelated to Motorsport Calibrations after a vehicle remap, liability for the installed parts and their impact on performance transfers to the vehicle owner.


Emissions Compliance

  1. Off-Road Use Only: Certain modifications, such as decats and DPF deletes, may render your vehicle non-compliant with the Road Vehicles (Construction and Use) Regulations 1986 and UK MOT standards. These modifications are intended for off-road use only. Customers are responsible for ensuring their vehicle meets all legal requirements for road use. Non-compliance may result in legal penalties, including fines or impoundment, which remain the sole responsibility of the vehicle owner.

  2. Legal Compliance: Motorsport Calibrations assumes no liability for non-compliance with emissions or road-use laws.


Risk of Damage

  1. Inherent Risks: Tuning pushes your vehicle closer to its performance limits. This may result in mechanical or component failures. Motorsport Calibrations takes all reasonable precautions to minimize these risks but cannot be held liable for damage caused by mechanical failures, pre-existing issues, or improper maintenance.

  2. Monitoring Equipment: To ensure safety, customers should use wideband air-fuel ratio (AFR) gauges, boost gauges, and other diagnostic tools during tuning. Regular post-tuning inspections are strongly recommended to maintain the health of vehicle components.

  3. Component Limits: Tuning beyond Stage 1 or equivalent places additional stress on components such as turbos, clutches, and gearboxes, which may exceed manufacturer tolerances. Customers accept responsibility for potential failures.


Tuning Environment

  1. Rolling Road Dyno: For best results and to ensure safety, Motorsport Calibrations recommends that tuning be carried out on a rolling road dyno. This controlled environment allows for precise adjustments and minimizes risks to the vehicle and driver. Dyno time and associated costs are not covered by Motorsport Calibrations and must be arranged and paid for by the customer.

  2. Public Road Usage: Tuning on public roads is strongly discouraged due to safety concerns and legal restrictions. Motorsport Calibrations accepts no liability for accidents, injuries, or legal consequences resulting from tuning activities conducted on public roads.

  3. Dyno Figures: Figures produced on the rolling road dyno are subject to environmental factors and may vary between sessions or different dynos.


No Warranty or Guarantee

  1. Performance Outcomes: Motorsport Calibrations cannot guarantee specific performance figures or results, as outcomes depend on the vehicle’s condition, modifications, and external factors, such as environmental conditions.

  2. Reliability: While every effort is made to ensure tuning reliability, long-term durability is affected by maintenance practices, driving habits, and component quality.


Refund and Revision Policy

  1. Assessment Period: If faults arise within 30 days of tuning, the vehicle must be returned to Motorsport Calibrations for assessment. Work carried out by third parties without prior approval will void the tuning warranty.

  2. Refund Eligibility:

    • If the tuning is determined to be the cause of the fault, we will offer a full refund and return the vehicle to its stock configuration. Alternatively, we can amend the tune at no extra charge.

    • Refunds will not be issued for dissatisfaction with expected performance unless mechanical issues caused by the tune are confirmed.

  3. Diagnostic Fees: A fee of £100+VAT applies for diagnostics if the issue is unrelated to the tune.

  4. Delayed Requests: Refunds require tuning removal within 30 days of the tuning date. Delays due to customer availability or other reasons will void refund eligibility, except in documented emergencies.

  5. Revision Policy: After a remap, the customer is entitled to a single revision in the first week. Additional revisions are charged at £300 per session.


Post-Tuning Responsibilities

  1. Maintenance: Regular servicing, oil checks, and the use of high-quality fuel are essential for maintaining engine health and performance after tuning. We recommend oil and filter changes every 5,000 miles or 6 months, whichever comes first.

  2. Serviceable Parts: Motorsport Calibrations is not liable for wear or damage to serviceable parts such as turbos, clutches, gearboxes, or other components post-tuning. Customers must ensure regular maintenance.


Data Usage and Privacy Policy

  1. Data Collection: During the tuning process, certain vehicle data may be collected to optimize performance. Motorsport Calibrations ensures that all data is handled in compliance with GDPR and is used solely for tuning purposes.

  2. Customer Responsibility: Customers must not share tuning files or proprietary software provided by Motorsport Calibrations with third parties. Unauthorized use or distribution of these files may result in legal action.

  3. Data Storage: Collected data will be stored securely and will not be shared with third parties without the customer’s explicit consent, except as required by law.


Use of Third-Party Services

  1. Third-Party Tools: Motorsport Calibrations may use third-party software or hardware to complete the tuning process. While these tools are chosen for their reliability, Motorsport Calibrations is not responsible for malfunctions or errors caused by third-party products.

  2. Customer Use: Any misuse of third-party tools by the customer is not the responsibility of Motorsport Calibrations.


Limitations on Vehicle Use Post-Tuning

  1. Purpose-Specific Modifications: Any modifications made to your vehicle are for the specified purposes discussed before tuning (e.g., racing, off-road use). Using the vehicle beyond the agreed-upon purpose may result in unexpected consequences, for which Motorsport Calibrations assumes no liability.

  2. Restricted Conditions: Do not use the tuned vehicle in extreme conditions (e.g., towing heavy loads or prolonged high-speed driving) unless explicitly approved during the tuning process.


International Customers

  1. Customs and Duties: International customers are responsible for all customs duties, import taxes, and fees associated with shipping any parts, tools, or software required for the tuning process. Motorsport Calibrations is not liable for delays caused by customs clearance.

  2. Compliance with Local Laws: Customers must ensure that all modifications comply with their country’s emissions, road safety, and insurance regulations. Motorsport Calibrations assumes no liability for non-compliance with local laws.

  3. Technical Support: Support for international customers may be limited due to time zone differences. Customers should schedule tuning sessions in advance to ensure availability.

  4. Shipping Costs: All shipping costs related to international tuning services, including returns or exchanges, must be covered by the customer.


Indemnification Clause

  1. Customer Indemnity: By engaging in our services, the customer agrees to indemnify and hold harmless Motorsport Calibrations, its employees, and affiliates from any claims, damages, or expenses arising out of the misuse of the vehicle, non-compliance with legal obligations, or third-party actions related to the tuning.


Force Majeure

  1. Unforeseen Events: Motorsport Calibrations is not responsible for delays or failures in the tuning process caused by events outside our control, including but not limited to natural disasters, cyberattacks, or power outages.


Disclaimer of Liability

Motorsport Calibrations does not exclude liability for death or personal injury caused by negligence. However, we are not liable for:

  • Mechanical failures caused by pre-existing issues.

  • Installation errors or misuse of customer-supplied parts.

  • Legal or compliance issues resulting from emissions-related modifications.

  • Accidents, injuries, or legal consequences arising from tuning conducted on public roads.

Customers are responsible for disclosing modifications to their insurance providers, as required by UK law.


Acknowledgment

By using Motorsport Calibrations’ remote standalone ECU tuning services, you acknowledge that you have read, understood, and agreed to this disclaimer in its entirety.
