DEFINITIONS

Any reference to Motorsport Calibrations/the Company/Seller/We/Us shall mean Motorsport Calibrations, operating from 846 Green Lanes, Winchmore Hill, London N21 2RT United Kingdom (Registered Office). The website www.motorsportcalibrations.co.uk is operated by us. As the user of the website (referred to as "you/your"), you acknowledge that any use of this website, including any transactions you make ("use/using"), is subject to our terms and conditions below.

Please read through these terms and conditions carefully before using the website or placing an order. We recommend printing a copy for future reference. Additionally, take time to read our privacy policy regarding how your personal information is used.

Any reference to You/Buyer/Purchaser shall mean any person, sole trader, partnership, business, body corporate, or other entity detailed in the appropriate section of the sales invoice/order form and shall include all successors, heirs, and assigns. Where the Buyer purchases in the course of trade, profession, vocation, or sport (as a specialist or enthusiast), it is agreed that such a buyer shall mean a trade buyer. Where a person deals entirely as a consumer, statutory rights remain unaffected. Where the term "buyer" appears, it shall mean both trade and consumer buyers unless specified otherwise. If you are not a consumer, you confirm that you have authority to bind any business on whose behalf you place an order.

We reserve the right to change these terms and conditions at any time. Changes will take effect when posted on the website and will be dated accordingly. It is your responsibility to read the terms and conditions each time you use this website. Continued use signifies acceptance of the latest terms.

GOODS AND SERVICES

Goods or equipment ordered shall mean the items detailed in the appropriate section of the sales/order form. Additional parts, connecting components, or ancillary items not detailed within the sales order form shall be considered additional to this agreement.

Price refers to the consideration due for purchase and includes VAT and other applicable taxes unless stated otherwise. Purchasers should note that prices quoted may vary during the currency of brochures (upwards or downwards), with current prices quoted at the time of order.

1. All orders placed on this website will be subject to acceptance under these terms and conditions.

2. Following submission of your order, we will send an acknowledgment email detailing the products ordered. This email is not an order confirmation or acceptance.

3. Acceptance occurs upon dispatch of the products ordered unless you are notified otherwise or cancel your order.

SHOPIFY-SPECIFIC FEATURES

1. Order Processing: Orders placed via Shopify will be processed through the platform’s secure payment gateway. Customers will receive an order confirmation email and a subsequent dispatch notification once the order has shipped. Shopify's real-time tracking functionality ensures you can monitor your order status.

2. Payment Methods: Payments are accepted via Shopify Payments, credit cards, debit cards, PayPal, and Klarna. Klarna acts as a third-party credit broker, offering financing options for eligible orders. By selecting Klarna, customers agree to their terms and conditions and understand that Motorsport Calibrations is not responsible for decisions made by Klarna regarding credit approvals or rejections.

3. Customer Accounts: Customers have the option to create a Shopify account to track their order history, manage personal details, and expedite future purchases. The use of accounts is subject to Shopify’s terms and conditions.

4. Data Processing and Privacy: Shopify acts as a data processor for your personal information, ensuring compliance with UK GDPR regulations. Please review our privacy policy for additional details.

GENERAL INFORMATION

Website information and samples on display are indicative only, and any specifications, weights, measurements, and technical data (whether relating to performance or otherwise) have been prepared by manufacturers and are for guidance only. Additionally, parts or components pictured or described within the website are for illustration purposes only and may vary in size, specification, color, and fitment depending on the make and model of your vehicle. Buyers are required to check current specifications, colors, weights, and measurements with manufacturers or the Company prior to order. Manufacturers allow tolerances within their product manufacturing processes and reserve the right to amend specifications, without notice, to improve products or when necessary. The Company shall endeavor to inform the Purchaser of any such amendments or changes where possible.

The Company reserves the right to amend technical or clerical errors in any order without notice. Additionally, the Buyer shall ensure that all details contained within the order are correct prior to submission to the Company. Subsequent to delivery, the Company shall accept no liability for any error or inaccuracy in the order unless notified of such error within seven days of delivery/receipt of any document containing the said error. "Working day" means any day excluding Saturdays, Sundays, and public/bank holidays. These terms apply to all quotations, contracts, orders (including telephone, postal, and internet orders) for the sale or supply of goods accepted by the company.

Website information and product samples are indicative only. Specifications, weights, measurements, and technical data provided by manufacturers are for guidance. Variations in size, specification, color, or fitment due to vehicle make and model are possible. Buyers must confirm current specifications before ordering. Manufacturers reserve the right to amend specifications without prior notice.

Delivery charges and estimated timescales are specified at checkout. We make every effort to deliver goods within the estimated timescales; however, delays are occasionally inevitable due to unforeseen factors. Motorsport Calibrations is not liable for any delay or failure to deliver the products within estimated timescales. If delays occur, we will contact the customer promptly to provide options, including revised delivery dates, order cancellations, or refunds if necessary.

1. Risk of loss and damage of products passes to you on the date when the products are delivered or on the date of first attempted delivery.

2. Unless otherwise stated, all shipments will be dispatched within 48 hours, and the transit time will depend on the courier chosen. Please contact us if you require an alternative shipping method.

RETURNS AND CANCELLATION

1. Your Right to Cancel Goods Ordered:

   • Consumer buyers residing within the European Economic Community have the right to cancel any contract for goods made via distance communication, in accordance with the Consumer Contracts Regulations. Cancellations must be made within 14 working days of delivery.

   • Special-order goods are not returnable under this clause.

   • Cancellations must be submitted via written notice, signed by the consumer buyer, and include the company’s sales order number, as well as the name and address of the consumer buyer. Notices can be sent by post to the registered office address or by email to Motorsport_Calibrations@outlook.com.

2. Return of Goods Post-Cancellation:

   • Upon cancellation, the consumer buyer must return the goods promptly, in original packaging, and without use or installation. All seals and enclosures must remain intact. The consumer buyer is responsible for return shipping costs unless goods are faulty or incorrectly supplied.

   • If the buyer does not return goods within 14 days of cancellation, Motorsport Calibrations reserves the right to collect the goods and recover associated costs.

   • Refunds will be processed within 30 days of receiving the returned goods or the cancellation notice, whichever occurs later. Refunds may be subject to deductions for reasonable costs or outstanding amounts owed by the buyer.

3. Trade Buyers:

   • Goods purchased by trade buyers may be returned in original packaging, unused, and with seals intact, within 7 days of receipt. Returns are subject to a restocking charge of at least 10% of the order value. Trade buyers must arrange and pay for return shipping. Special-order items are non-returnable.

4. Non-Returnable Items:

   • Certain goods are not eligible for return, including but not limited to:

     • Specially ordered items.

     • Electrical parts.

     • Glass components.

     • Hazardous materials or items with damaged or missing seals.

     • Goods covered in grease/lubricant or otherwise not in resalable condition.

     • Items purchased as part of promotions or sales campaigns.

5. General Return Policy:

   • Customers must obtain a Returns Notice Number (RNN) before returning any goods. Packages without an RNN will not qualify for refunds or credits.

   • Goods must be securely packed to prevent transit damage. Motorsport Calibrations is not liable for goods damaged in return shipping.

   • Refunds for valid returns will be issued within a reasonable time, subject to inspection of the goods.

   • Customers experiencing delays with refunds should contact their payment provider or bank before reaching out to Motorsport Calibrations for assistance.

6. Returns Procedure: Before returning any goods, customers must contact Motorsport Calibrations by email at Motorsport_Calibrations@outlook.com or by phone at +44 (0) 7985319479 within 7 working days from the day of delivery to obtain a Returns Notice Number (RNN). Items sent without an RNN will not be eligible for a refund.

7. Eligibility for Returns:

   • Goods must be in resalable condition, unused, and in original packaging with all relevant documentation (e.g., invoice and RNN).

   • Used, fitted, or installed parts, as well as certain exempt items such as electrical components and perishable goods, are not eligible for return.

8. Refund Policy:

   • For correctly supplied orders:

     • Within 14 days of delivery: Goods can be returned for a store credit, excluding the initial delivery charge. Return postage costs are the responsibility of the customer.

     • After 14 days but within 28 days: Goods can be returned but are subject to a 20% handling fee. Initial and return delivery charges are non-refundable.

     • After 28 days: Goods are not accepted for return.

   • For incorrectly supplied orders:

     • Within 28 days: Goods may be returned for a full refund, including initial and return shipping costs, provided they are in resalable condition.

9. Special Order and Sale Items:

   • Special order items carry a 30% restocking fee.

   • Sale items are non-refundable.

10. Gifts:

    • If marked as a gift, the customer will receive store credit upon return. Refunds for gifts will only be issued to the original purchaser.

11. Return Shipping: Items must be securely packaged to prevent transit damage. Motorsport Calibrations will not be held liable for goods damaged during return shipping.

12. Refund Processing: Refunds will be processed within a reasonable time after receipt and inspection of the returned goods. Customers will be notified of approval or rejection of their refund.

13. Late or Missing Refunds: Customers should check their bank and payment method provider for delays before contacting Motorsport Calibrations for assistance with missing refunds.

LIABILITY AND INDEMNITY

1. Nothing in these terms and conditions excludes or limits liability for death or personal injury caused by negligence, fraudulent misrepresentation, or any other liability which may not otherwise be limited or excluded under applicable law.

2. Motorsport Calibrations will use reasonable endeavors to verify the accuracy of any information on the site but makes no representation or warranty of any kind, express or implied, statutory or otherwise, regarding the contents or availability of the site or that it will be timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs. Motorsport Calibrations will not be responsible or liable for any loss of content or material uploaded or transmitted through the website and further accepts no liability of any kind for any loss or damage from action taken or reliance on material or information contained on the site.

3. Subject to these terms and conditions, other than as expressly provided in these terms and conditions with respect to specific products, any indemnities, warranties, terms, and conditions (whether express or implied) are hereby excluded to the fullest extent permitted under applicable law.

4. Subject to these terms and conditions, Motorsport Calibrations will not be liable, in contract, tort (including, without limitation, negligence), pre-contract, or other representations (other than fraudulent or negligent misrepresentations) or otherwise out of or in connection with the terms and conditions for any:

   • Economic losses (including without limitation loss of revenues, data, profits, contracts, business, or anticipated savings);

   • Loss of goodwill or reputation;

   • Special or indirect losses suffered or incurred by that party arising out of or in connection with the provisions of any matter under these terms and conditions.

5. Notwithstanding the above, Motorsport Calibrations’ aggregate liability (whether in contract, tort, or otherwise) for loss or damage shall in any event be limited to a sum equal to the amount paid or payable by you for the product(s) in respect of one incident or series of incidents attributable to the same cause.

6. This clause does not affect your statutory rights as a consumer, nor does it affect the contract cancellation rights of a consumer purchasing by means covered by the Consumer Contracts Regulations.

7. We will take all reasonable precautions to keep the details of your order and payment secure, but unless we are negligent, we cannot be held liable for any losses caused as a result of unauthorized access to information provided by you.

8. Advice given by employee representatives during telephone/Internet orders is based entirely upon information provided by you, the purchaser, without inspection of any vehicle or part undertaken. All advice should be checked by the purchaser prior to order. Where advice is given after visual inspection, such advice shall amount to an opinion only.

9. Goods are supplied only to correspond to the purposes for which such goods are commonly supplied and not alternative uses. No liability for failure can be accepted for alternative use, amendment, or modification.

10. For trade buyers, the company excludes liability for any express or implied condition, warranty, or term, and the buyer warrants they carry adequate insurance to cover any losses resulting from a breach of this agreement.

11. Goods incompatible due to vehicle modifications may be accepted back into stock at the company’s discretion. Special-order items will not qualify for return.

12. Competition-grade parts are supplied for specialist use and are subject to extreme stress. Life expectancy is reduced, and any claims for failure/wear shall not be entertained.

13. Motorsport Calibrations shall not be liable for losses due to delays, modifications, or usage in competitive conditions. Any liability for death or injury is limited to cases of direct negligence by the company.

14. The company accepts no liability for interruptions caused by strikes, civil disputes, acts of God, or third-party actions. Assignments or sub-contracting of rights under this agreement are subject to prior approval by Motorsport Calibrations.

15. Motorsport Calibrations makes no warranties regarding the functionality or availability of the website. While efforts are made to maintain accuracy, no guarantees are provided. If website issues result in failed transactions or order processing errors, Motorsport Calibrations will endeavor to rectify the issue promptly and ensure that affected customers are notified and offered appropriate remedies, such as reprocessing the order or issuing a refund where necessary.

16. We are not responsible for any indirect or consequential damages, including economic losses or reputational harm, arising from website use or reliance on provided information.

17. Liability for defective goods is limited to repair, replacement, or refund.

WARRANTY

1. Guarantees for products are provided entirely by the manufacturers/importers and are subject to the terms specified by them. Purchasers are reminded to complete and return all warranty cards or relevant documents upon receipt of goods where appropriate.

2. Products modified or adapted by the purchaser are not covered under warranty.

3. The warranty does not cover faults or failures resulting from misuse, improper installation, or use outside of the product’s intended purpose.

4. Customers must contact Motorsport Calibrations for assistance with warranty claims. Claims may require proof of purchase and detailed information about the fault or issue. 

5. Motorsport Calibrations acts only as a facilitator for warranty claims with the manufacturer/importer and is not responsible for decisions made by them regarding repair, replacement, or refund.

6. Any warranty claim must be initiated within the specified warranty period stated by the manufacturer, starting from the date of purchase.

JURISDICTION

These terms and conditions, and any contracts formed under them, shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms, or the use of this website, shall be subject to the exclusive jurisdiction of the English and Welsh courts.

This agreement does not intend to create any partnership, joint venture, or agency relationship between the buyer and Motorsport Calibrations. Neither party shall have authority to act as agent for or bind the other in any way.

The language of this contract is English, and all communications regarding its terms and conditions must be conducted in English.
